These Terms & Conditions ("Terms") govern your access to and use of Pacept's websites, dashboard, checkout, and APIs (together, the "Services"). By creating an account or using the Services, you agree to these Terms on behalf of yourself and the business you represent.
1. Eligibility & accounts
You must be a registered business or an authorised representative of one, and at least the age of majority in your jurisdiction. You are responsible for the accuracy of the information you provide and for all activity that occurs under your account. Keep your credentials, API keys, and webhook secrets secure; you must notify us immediately of any unauthorised use.
2. Verification (KYC)
To use payment collection and payout features, you must complete our business verification process. We may request additional information at any time and may suspend or limit your account if verification is incomplete, inaccurate, or cannot be validated.
3. Collections & payouts
Pacept enables you to collect payments from your customers and receive settlements to your designated bank account. Collected funds are settled and scheduled for automatic payout in accordance with our payout schedule. Payout timing may be affected by verification status, risk review, banking partners, or public holidays.
4. Fees
Applicable fees are presented to you within the dashboard or your commercial agreement and may be deducted from amounts collected. We may update fees with reasonable prior notice.
5. Acceptable use
You agree not to use the Services to:
- facilitate fraudulent, illegal, or prohibited transactions;
- process payments for another business without authorisation;
- circumvent security controls, or probe or test the platform without permission;
- infringe the rights of others or violate applicable laws or card-network rules.
6. API & integrations
Your use of the API is subject to any rate limits and documentation we publish. You are responsible for validating webhook signatures and for the security of the endpoints you configure. We may modify or deprecate API functionality with reasonable notice.
7. Suspension & termination
We may suspend or terminate your access if you breach these Terms, present a security or compliance risk, or as required by law or our banking partners. You may stop using the Services at any time. Certain obligations survive termination, including outstanding fees and settlement of pending transactions.
8. Disclaimers & liability
The Services are provided "as is" without warranties of any kind to the maximum extent permitted by law. To the extent permitted by law, Pacept is not liable for indirect, incidental, or consequential damages, and our aggregate liability is limited to the fees you paid to us in the three months preceding the event giving rise to the claim.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the dashboard or by email. Continued use of the Services after changes take effect constitutes acceptance.
